definition of orthopedic shoes

Dear list I am involved the with Massachusetts Society of Orthotics & Prosthetics (MSOP) working with MA Medicaid trying to re-write the regulations for O&P. This has been a long slow process but we feel we are making progress. One of our stumbling blocks is a current regulation that Medicaid will only pay for foot orthoses when fit into an "Orthopedic Shoe". We need to re-write a definition for "Orthopedic Shoes" that will allow use to use well constructed athletic shoes. Does anyone have a definition for orthopedic shoes other than Leather uppers, counters, inner sole and outer soles with a Goodyear welt construction. All assistance is greatly appreciated.
